GurugramFrom Salon, Gym, Grocery Store, Clinic to Small Restaurant, DLF Areas have become strongholds of illegal trade commercial activities. Developers share list of 742 illegal commercial establishments in their licensed colonies- DLF 1 to 4 — with the Department of Town and Country Planning (DTCP) Demand action against the owners of these properties.
The developer stated that illegal commercial activities were being carried out from the residential units in violation of norms framed under the Haryana Development and Regulation of Urban Areas Act, 1975. The developer, in the letter along with the list of such residential properties, said that these illegal commercial activities are putting additional burden on the civic infrastructure and thus causing inconvenience to the residents. The developer has now sought action against such property owners.
In a letter to the district town planner (enforcement) dated March 29, company officials said that apart from unauthorized construction, illegal commercial units including guest houses, PGs, restaurants and offices are violating approved plans. “This has increased the density of population in the area beyond a sustainable level and has put at risk the amenities and services like water, sewer, electricity and roads in DLF colonies.”
The developer further added, “We have been receiving several complaints from RWAs and residents regarding problems caused by illegal construction and commercialization in residential areas. These activities have created major problems for law-abiding residents. In the interest of these residents, DTCP is requested to take strict action against the offenders as this has not only severely affected the facilities but also poses a serious risk to life and property and may lead to major disaster.
Based on the complaint, the enforcement wing of the department has constituted a team under the assistant town planner to conduct the survey and serve notices to the violators.
Manish Yadav, District Town Planner (Enforcement) said, “We have received a letter from the developer on illegal commercial activities going on from residential areas. A team has been constituted with two junior engineers under the leadership of the Assistant City Planner to conduct the survey. Once the survey is done, the identified properties will be served show cause notices and restoration orders.” He said that if the property owners fail to restore the buildings, their occupation certificates will be taken back and a sealing drive will be carried out. “The department will also write to the tehsildar for not approving the sale and purchase of such properties,” he said.
As per the rules, no commercial activity can be conducted except a few from the residential buildings. Certain activities, which fall under the non-nuisance category, are permitted only on the ground floor, covering more than 25% of the area or 50 sqm, whichever is less. Only they have been issued “non-disruption certificates”. Non-nuisance business activities are those which are performed by an individual using his personal skills and intelligence.
