Stop builders from taking advance maintenance: Mumbai Grahak Panchayat

Pune: State Consumer Body Mumbai Grahak Panchayat (MGP) has sought instructions Maharera President Ajay Mehta So as to prevent promoters from charging upfront maintenance charges from home buyers.

It also asked the authority to ensure formation of cooperative housing societies after more than half the home buyers have booked flats.

MGP Chairman Shirish Deshpande said that charging advance maintenance of one or two years is against the Real Estate Regulatory Authority.Rare) Act, 2016. “MAHARERA has been issuing several guidelines in the interest of homebuyers, we are hoping that this too will be taken into consideration as it will help homebuyers,” he told TOI.

“In line with Section 11(4) (e) of RERA, 2016 and Rule 9(1) of MahaRERA, the promoter is required to take necessary steps to form an association or co-operative society of the allottees within three months of the majority of the allottees booking the apartments. , the collection of this maintenance is absolutely unnecessary,” he said, adding that the practice of collecting advance maintenance is “manifestly unfair, unjustified and illegal”.

Sheetal K, who had recently taken possession of her flat, was asked to pay maintenance amount in advance at the time of booking. “The builder has promised us the vehicle soon and hence all our members have agreed to pay one year’s maintenance. However, we are quite sure that the vehicle will not be delivered so soon,” he said.

State CREDAI president Sunil Farde said the maintenance amount was collected for the smooth functioning of the society as well as to pay for electricity, water, security and housekeeping. “The developers ensure that they give income expenditure details to the society members. The vehicle is delayed many times and hence the amount is collected to ensure the smooth functioning of the society,” he said.
