Developer served notice for green rule violations at Kensington Park 1, Real Estate News, ET Real Estate

NoidaShow cause notice has been issued by the committee appointed by NGT. Jaypee Infratech And the Insolvency Resolution Professional (IRP), handling the insolvency case of the beleaguered realtor, is asking why environmental compensation of Rs 5.47 lakh should not be imposed for violation of green norms in the Kensington Park-1 project.

The move comes in the wake of a resident’s complaint over violation of green norms, including sewer overflow from manholes, in several blocks of Kensington Park-1 in Sector 133. Kensington Park has a number of independent houses and residential towers. Some 19 towers are under construction while 811 plots have been allotted.

Officials said the show-cause notice was issued after an inspection by a committee appointed by the NGT, comprising officials from the district administration and the Uttar Pradesh Pollution Control Board.UPPCB), was held on 3 February and a report was submitted to the tribunal on 10 February.

UPPCB regional officer Praveen Kumar said, ‘During the inspection, it was found that the project proponent has not made arrangements for dust control at the construction site as per rules. Proper water sprinkling, physical barricading of the area and other dust mitigation measures were not taken care of.

According to the residents, the occupancy was given in 2015 before the completion of the project.

“Residents complained that due to lack of proper disposal of domestic waste generated from their houses, flows through manholes, causing inconvenience. ADM (Administration) Nitin Madan said, during the inspection, manholes of the project were seen but there was no overflow.

During the inspection, officials said, the developer told the committee members that it would take more than six months to complete the installation and operation of the sewage treatment plant (STP).

“We were informed that as an alternate arrangement, sewage generated from the project is being disposed of through tankers. However, no evidence in this regard was provided by the project proponent,” said Kumar.

Complainant Nishant Bhargava said that in the past also he had written a letter to the CEO of Noida Authority regarding the failure of the builder to provide necessary facilities. “In September 2022, I approached NGT after not getting any response from the authority. We residents are facing a lot of problems due to lack of STP.”

The representatives of the developer could not be reached despite repeated attempts.
