Paranjpe Construction asked to pay compensation for failure to execute sale deed

Thane: Thane District Consumer Disputes Redressal Forum has ordered a construction firm and its partner to pay a compensation of Rs 30,000 each to 45 people who had bought flats in their scheme. Vasai in Maharashtra in 1986, for failing to execute sale deeds against the properties purchased all these years.

Forum President VC Premchandani and its member Poonam V Maharishi ordered Paranjpe Construction Company and his accomplice Jayant Moreshwar Paranjpe were asked to pay jointly within 30 days of the order passed on January 13. Advocate Ashwini Sarjeene appeared on behalf of the complainants. However, the opponents did not appear for the hearing and the case against them was decided ex-parte.

In his submission, Sarjaine told the forum that in 1986 the complainants had booked flats of 410 square feet in the company’s housing scheme in Vasai. Palghar District Seoni. They had paid Rs 95,000 each as booking amount for the purchase of the flat.

He said that the complainant had started living in the flat 26 years ago, but the company has not yet executed the sale deed. Therefore the complainants had issued legal notices to the opposite parties for not executing the sale deed or alternatively to refund the amount as per the market rate of the properties.

But since the opposite party did not comply with the notice, the present complaint has been filed. In its order, the forum pulled up the opponents saying they indulged in “unfair trade practice”, the opponents failed to appear for the proceedings and did not file their defence.

Therefore, the arguments advanced by the complainants against the opponents stand to be proved against them. The forum asked the opponents to pay Rs 30,000 to each of the complainants for their litigation allegations. Also directed to execute the sale deed.
