Jaipur: Notwithstanding the implementation of the Real Estate (Regulation and Development) Act, 2016 (Rare) has tightened regulations within the real estate market, with unregulated plotted colonies on agricultural land continuing to be a problem in the state capital, posing a risk to home buyers.
Illegal housing schemes continue to flourish and pose a risk to buyers, as is evident from the experience of a person who recently approached RERA with a complaint. “A farmhouse scheme was developed near Kalwar toll. As an investor, I checked the creditworthiness of the scheme and found that the project was not registered as per the mandatory provisions. I filed a complaint with RERA regarding this, and RERA issued a notice to the developers of the scheme on 5th July. Illegal colonizers continue to cheat investors,” said the person on condition of anonymity.
The Urban Development and Housing (UDH) department has asked RERA to check the authenticity of housing projects and ensure developers deliver on their commitments. But real estate dealers and agents are duping home buyers by offering plots for sale in non-regulated colonies developed on agricultural land. It will hardly help that the state government has banned housing societies from issuing lease deeds in colonies developed after June 17, 1999.
According to people in the know of the real estate market, unscrupulous developers buy agricultural land and illegally issue backdated lease deeds.
The state government and RERA keep getting requests from the victims of fraud to develop a mechanism to monitor illegal colonies.
The victim, Vijay Singh, said, “My widowed mother-in-law had bought a house in Ganesh Vihar near Vatika two years back. Now there is a dispute between the land owner and the developer and the developer has refused to hand over the possession of the plot. Our hard earned money was wasted. RERA should develop a mechanism to prevent illegal colonies from developing on agricultural land.
Dealers and agents of developers often lure buyers with promises of various amenities in upcoming colonies like spacious parks, green belts, potable drinking water, well-maintained roads, sewerage facilities and electricity connections. Many buyers complain that once the plots are sold, the dealers disappear, and buyers are left at the mercy of the agents.
“As per the proposal for the colony, the developer had promised that 60% of the total land would be allotted for plots and the remaining 40% for amenities like parks, roads and a community hall etc. On Tonk Road in Zone 14 in Meri Colony near Beelwa, the developer cheated the customers as 80% of the area is being used for plots for high profits,” said Bharat Jain, a victim of Bajrang Vihar near SEZ.
A senior RERA official said that only approved colonies come under the purview of the authority. “Those who are illegally developing colonies on agricultural land and selling them are not under the RERA scanner. It is difficult to get details about such colonies,” he said.
