Mumbai: Municipal Commissioner Iqbal Chahal has approved the proposal to allow transfer of development rights ,TDR) For redevelopment of old buildings which are on internal roads such as private layout road, provided the width of the road is at least 9 meters and 50 meters from the public road.
More importantly, a deed would need to be registered in order to maintain private access forever. TDR shall also be permitted in the case of plots where the minimum width of the private layout road is reduced by some length. Real estate industry observers said this would enable the redevelopment of many older buildings.
Chahal, however, deferred the decision on allowing TDR for landlocked plots, i.e. plots where the right of way is provided through another plot. The approval was issued following a representation from the Association of Practicing Engineers, Architects and Town Planners.
Building construction proposal department to ensure smooth implementation BMC Shall record the width of all layout / town planning or BMC Right of way along with estate planning roads. The commencement certificate of any building on such roads shall be issued on the condition that the road shall first be developed to its full width and shall not be reduced in future, the approval states.
