New Delhi: The Economic Offenses Wing of Delhi Police has issued a notice Mohammed Ali AlbarFounder and Managing Director of Dubai based Emaar Properties, asked him to appear on Friday for questioning in a case of alleged forgery and criminal breach of trust related to a housing project in Gurugram. When contacted by a PTI spokesperson Emaar India Admitted that he had received the notice.
“The matter pertains to a civil case filed by some homebuyers against banks from whom they had taken loans for properties worth approximately Rs 1 crore, where Emaar executives have been made a party,” the spokesperson said.
As per the police notice, Alabar, who is one of the directors of the India subsidiary of the real estate firm – Emaar India Ltd. – along with three other senior officials of the country, have been asked to appear before it for questioning in the matter.
“It is informed that the matter (regarding Palm Garden Project) The investigation is being conducted by Section IV of the Economic Offenses Wing, Delhi Police, New Delhi.
“The matter is being investigated against M/s Emaar India Limited, formerly known as Emaar MGF Land Limited and its directors for their housing project “Palm Garden”, situated at Village Kherki Daula, Sector 83, Gurugram.”
Stating that Alabar has been named as an accused in the FIR and assuming that he is conversant with the facts and circumstances of the case regarding the commencement/booking of the project, the notice issued by the Investigating Officer states, ” I hereby inform you that there are reasonable grounds for questioning you to ascertain the facts and circumstances in connection with the present investigation.”
He has been asked to appear at the Economic Offenses Wing (EOW) office of Delhi Police at 2.30 pm on June 2.
The EOW launched a probe on January 30 into an FIR by a homebuyer, Manish Kumar Patni, alleging that Emaar India Ltd committed forgery and criminal breach of trust, among other offences, in selling apartments in its “Palm Garden” real estate project Is.
According to the FIR, the project was launched in 2010 and the company promised to deliver housing units to buyers by September-December 2015.
Patni alleged that the company collected money from buyers and diverted it for other purposes, leading to inordinate delay in the completion of the project. He also alleged in the FIR that the company misrepresented the layout plan, did not obtain necessary permissions and approvals from the concerned authorities at the time of sale of apartments and made false promises with the sole objective of deceiving homebuyers.
The complainant has also named certain banks and financial institutions in the FIR, accusing them of being in collusion with the real estate company.
An Emaar India spokesperson said the dispute was primarily civil in nature. “We are following the due process of law and extending our full support and cooperation for a fair and just investigation into the matter,” the spokesperson said.
