Town planner scraps OC of Society Club, ET Real Estate

GurugramAfter lodging of FIR against : Malibu Estate and five other companies, the Department of Town and Country Planning (DTCP) on Tuesday canceled the occupation certificate (OC) of malibu townUnauthorized construction has been done in the building premises of the club.

According to sources, the department may also seal the club building after the violation of the Haryana Development and Urban Areas Act, 1975.

Senior town planner Sanjeev Mann said the department had issued show-cause notices to the developer and other concerned companies, but they failed to respond satisfactorily, following which the department took action. DTCP Wrote a letter to police chief Kala Ramachandran urging him to register an FIR against the developer and the companies. “Now we have canceled the occupation certificate as there were violations in the building plan,” he said.

Meanwhile, on the directions of the NGT, the Haryana Urban Development Authority (HSVP) has sought documents related to the project to verify its claims of reducing the green cover of the project. “Service plan estimate, occupation certificate files, part completion and approved completion certificates and other relevant documents have been sought from the developer,” said an official.

The alleged offense came to light when a resident lodged a complaint that the land belonged to the residents, but the builder first took possession of the land and then carried out construction.

In October 2022, the DTCP issued a show-cause notice under section 10(2) of the Haryana Development and Regulation of Urban Areas Act, 1975, and further restoration orders in March 2023 in respect of additions/alterations and unauthorized constructions in the building were passed. The Club at Maple Drive malibu town, Another notice was issued in January 2023 for encroachment in the park area and restoration order was issued in February 2023. However, the developer submitted his reply which was found unsatisfactory.

In March, the DTCP had requested the police chief to register an FIR against the accused companies. Sadar police had registered the case on April 6. Malibu Estate Pvt Ltd. and other concerned companies under Section 10(2) and 3 of the Haryana Development and Regulation of Urban Areas Act, 1975 for encroachment and unauthorized construction of park area. As per Section 3B of the Act, no person shall direct or redirect buildings in the colony except in accordance with the approved plan and subject to such restrictions as may be contained in the license.
