Nagpur: A builder is undertaking construction for a commercial complex on a vast plot in Civil Lines, which was occupied by Nag Vidarbha Chamber of Commerce (NVCC) since 1948 till few years ago, without approval of building plan for the last two months.
Nagpur Municipal Corporation (NMC) had issued the notice two days back. When TOI visited the site on Wednesday, the construction was underway.
Located Opposite Government Printing Press, the plot measures 40,000 sq.ft. An administrator appointed by the National Company Law Tribunal (NCLT) on January 31 on NVCC, an apex body of 13 lakh traders of Vidarbha, is examining all the Acts, resolutions. Decisions and agreements executed by the chamber or any of its former and present directors relating to the disputed issues raised by the four former presidents in a petition. The said land is also a part of the investigation.
Also, the Registrar of Companies (ROC) is investigating the said land.
For the base of the basement parking, the builder has started the concrete work by excavating up to 20 feet. NMC Dharmpeth zone issues notice to builder on June 12 after receiving complaint Bhagirath Realty Pvt Ltd to investigate the unauthorized construction within three days.
The NMC Town Planning Department on Wednesday issued notice to Bhagirath Realty Pvt Ltd through Director Ramesh Rander directing them to stop the work with immediate effect.
“It is seen that you have started construction without taking the approval of the building plan. Unauthorized construction is proved on the plot. You have been found guilty under section 52(1) of Maharashtra The Regional and Town Planning (MRTP) Act has not obtained approval as per Section 52, 53 and 54 of the MRTP Act.
The department has also sought clarification within two days. “In case of non-compliance of the notice, legal action will be taken as per section 52 of the MRTP Act. You will be responsible for any loss of life and property at the site,” the department said.
Rander did not respond to TOI’s calls and messages.
In its preliminary findings, the RoC’s office had said, “NVCC was in possession of 40,000 square feet of land with the structure since 1948. In 2008, the Madhya Pradesh Merchants Chamber of Commerce (MPMCC) filed an eviction suit, which was settled by the Additional Small, against the NVCC. Reason Judge. NVCC’s appeal was allowed. Besides, the landlord had also filed a review petition before the Small Causes Court.”
The RoC office observed that there was no rush for NVCC to rush to an out-of-court settlement with the landlord. The RoC found that Ashwin Mehdia, the then NVCC president and director, made misrepresentations of facts before the emergency general meeting.
“Mehadiya also did not explain the real strength of the tenancy rights as the chamber was in possession for more than 12 years and apparently, colluded with the landlord and gave him illegal advantage and caused wrongful loss to NVCC.
“Furthermore, Mehdia signed official documents of the company as director (chairman) even though he was ineligible to do so,” the report said.
Rander was one of the directors of the MPMCC.
The NMC also said in the notice that the builder violated the norms of environment and mineral exploration. The builder has put barricades on the retaining wall of the drain.
