Gurugram, DTCP The notice has been issued to the developer of Oyster Grand in Sector 102 after residents lodged a complaint alleging delay in handing over the maintenance of the residential society to the RWA. The developer has been asked to be present with all relevant documents in the meeting to be held on May 3.
DTCP Senior town planner Sanjeev Mann said he would chair the meeting, which would be attended by residents and developers. Adani M2K Projects LLP,
“We have received complaints from residents regarding transfer of the maintenance of the society to the RWA. We have called a meeting and will try to resolve the issue amicably.”
Launched in 2012 with over 750 flats, Oyster Grande was issued an occupancy certificate (OC) in 2018. Presently, more than 450 families are living here.
The society had elected its RWA in October last year and since then the residents have been demanding maintenance of the elected body. He alleged that despite several meetings and reminders, the developer is not ready to hand over the day-to-day affairs of the society to the RWAs. They complained that the developer was charging a monthly maintenance fee of Rs 7,000 to Rs 15,000 per flat. They have also sought transfer of Interest Free Maintenance Security (IFMS) collected from the residents.
“As per the terms of the OC, the developer has to hand over the maintenance to the RWA within 90 days, but we have been here for five years. The developer hasn’t made any effort for much maintenance. We will keep fighting for our rights and our hard-earned money,” said Hari Bhagwan, president of Oyster Grande RWA.
For the past two weeks, residents have been protesting against the developer over several maintenance issues, including poor maintenance of internal roads, neglect of parks, poor sewage treatment plants and CCTV cameras. Last week, the residents passed a resolution. And decided to pay common area maintenance to RWA instead of developer from 1st June.
“There are many issues related to maintenance. There is no proper solution despite raising it with the developer. We also staged a sit-in demonstration, but to no avail. We hope that the authorities will take immediate action to resolve the issues,” RWA Treasurer Navdeep Kaur said.
A spokesperson for the developer said they are aware of the meeting.
“Our officials will attend and present their stand as per applicable laws. We are committed to comply with RERA guidelines in this regard. Besides, we have already informed the RWAs about the legal modalities for handing over the facility management of the group housing societies to the RWAs that it will be done as per the norms,” the spokesperson said.
