Mumbai: The BMC According to an action plan drawn up by the civic body, it will issue stop-work notices followed by penal action to builders if they fail to initiate measures to control dust generated from construction sites.

If builders fail to self-certify that a construction site meets dust mitigation guidelines, such as erecting metal sheets around the perimeter of construction sites, water-staining during excavation and loading of construction materials/ Unloading and sprinkling of soil level from time to time. before the start of the excavation.

Under the Maharashtra Regional and Town Planning Act (MRTPA), the offense attracts a jail term ranging from one month to three years. For example, in case project proponent/architect/land surveyor fails to submit self-certification on compliance of dust mitigation guidelines on BMC website, a warning letter will be issued to the proponent for rectification/compliance within a week. In case the builder still fails to comply, further penal action will be initiated as per the provision of MMC Act or MRTPA, including issuance of stop work notice.

A ward level task force will visit project sites to inspect compliance and issue warning letters at the first instance of non-compliance. The task force will also submit a weekly action taken report to the concerned Assistant Commissioner. These are parts of the report submitted to Municipal Commissioner IS Chahal last week, which has been accepted. Additional Municipal Commissioner Dr Sanjeev Kumar said, “The report has been submitted and it has been accepted and the implementation will start at the earliest.”
Two weeks ago, Chahal constituted a seven-member committee to implement dust control measures in Mumbai starting April 1. The report, a copy of which is with TOI, lists immediate, short and long-term measures.
