HSPCB's closure orders for two realty projects in Panipat leave buyers fuming

Chandigarh : The Haryana State Pollution Control Board ,HSPCB) orders closure of two realty projects Panipat has started charging tolls on about 800 occupants or owners residentialCommercial and institutional properties.

In November last year, the HSPCB had ordered the closure of two projects being developed by two prominent developers, stalling any transactions related to the properties of the projects – such as conveyance deeds, sale deeds and property IDs issued To do – taking into account some violations by the builders, lapse of permissions and pending formalities.

It all came to light when Panipat Deputy Commissioner Sushil Sarwan on Friday urged the HSPCB chairman to withdraw the order on a representation made by aggrieved residents. Board chairman P Raghuvendra Rao confirmed receipt of the request, but said the action was a legal decision.

On the other hand, Varun Gulati, who was pursuing violations by builders in Panipat and Sonipathas alleged that the failure of the builders to comply with environmental laws and clearances has resulted in pollution of the Yamuna river.

On the other hand, RWAs of the two projects (one inscribed in Panipat’s Sector 37 and 39 and the other in Panipat’s Sector 19) are going from pillar to post to withdraw restrictions imposed by the town and country planning department. as well as the Department of Revenue.

As per information, the projects were prepared a decade ago and there is very little inventory of unsold plots available with the developers. As the developers did not comply with the approval, the Board, acting on the advice of the CPCB and the Green Bench, issued the closure orders. “What is wrong with a plot holder who has put in his entire life’s savings to build a house? Initially, the plots were transferred and many of us could not get the conveyance deed done as we did not have the resources. Now, we are unable to execute it either because of the developer’s fault or because of a conflict between the pollution control board, town and country planning and the builder,” said Suresh Gumber, president of the RWA of the project being built in Sector 19.

“If the builder is at fault, the board should stop the sale of unsold units or projects of builders elsewhere, why bother us? Here someone is waiting to build a house by taking a loan, someone wants to complete the documents.

Gulati said the main concern is compliance. “The builder was ordered to shut down on his Sector 37 and 39 projects as the project is in red category and was operating without obtaining valid consent to operate from HSPCB and also no environment clearance was obtained from MoEF And no STP was installed.The developer will be treating the domestic waste which is a clear violation of the Environment Act.

HSPCB Chairman P Raghuvendra Rao expressed his inability to respond immediately. “We have got a representation from Panipat DC. There should be a legal inquiry into the whole matter. We will also take the opinion of AG Haryana in this regard before taking any decision.
