The bone of contention in the redevelopment is the sale of 48 flats out of 279 units in the complex. GHB had recently issued an auction notice for these 48 flats, claiming them as its own under the agreement. The builder of Ekta Apartments issued a notice to the residents, stating that the possession and sale rights of the 48 flats were still with them and not with GHB.
The GHB, in its notice of auction of 48 flats, said that out of 48 units, 26 flats cost Rs 1.01 crore, 14 flats cost Rs 98.17 lakh and eight flats cost Rs 90.13 lakh. GHB had announced the auction of these flats on December 20.
A senior GHB official said though the four-decade-old society initially had around 60 houses and a few shops, the re-development deal involved construction of 279 houses, with GHB getting possession of 48 flats.
The GHB had approved the redevelopment of Ekta Apartments at Plot No. 297/Last of TP Scheme 29 in Naranpura soon after the water tank collapse in August 2017. A redevelopment agreement was signed between GHB and a developer.
The project was registered with Gujrera, wherein plans were passed to construct 279 units in four towers. The project was started in 2019 and was to be completed in 2023.
A senior GHB official said, “The developer has filed a claim in the civil court against the auction of 48 flats in Ekta Festival, but the court has not stayed it. We plan to go ahead with the auction. People are applying to buy flats. The original 60-odd residents have been allotted their flats. The developer argues that it has the right to sell these 48 flats and then pay the premium to GHB.
