Gurugram: Haryana Real Estate regulator authority (h-rare) is banned Mahira Group Cancellation of any units of the allottees in its affordable housing project in Sector 63A for non-payment of dues.
The regulator’s order comes in the wake of a petition by investors, who have claimed that 50% of the project cost has been paid, while only 5% has been constructed at the site.
The allottees alleged that the developer had in the first week of January threatened to cancel the allotment of units if the monetary demand raised by the group was not paid.
The regulator invoked Section 36 in its order on Thursday Rare Act to restrain the builder from canceling any units in the project till the date of next hearing.
“The developer is directed not to create third party encumbrances till the pendency of the present complaint. Further, the application received from the allottees shall be forwarded to the promoter for filing reply within two weeks.
In fact, even in its September 2022 order, RERA had restrained the builder from canceling any unit due to non-payment of due installments as per the original payment plan.
“We appreciate the RERA order but it just gave another date to the buyers. We need regular monitoring of project and planning related to construction for payment.
A spokesperson of the builder said, “The company is taking up the demand as per the norms and the project will be completed as per the commitment and the funds are required for the same.”
