Chhattisgarh RERA directs Housing Board to take up and develop residential projects

Raipur: First experiment of its kind Chattisgarh real estate regulator authority (Rare) has passed the order to hand over the private housing project located at Nardaha – valencia city until Chhattisgarh Housing Board In the interest of plot holders in this project.

RERA took this action when the promoter had promised basic facilities like road, electricity, water and sewerage. Aftab Siddiqui In the brochure, even after five years had passed, the project was not developed.

The promoter had promised to provide all basic facilities by bringing a housing project of 1072 plots in Nardaha, but even after five years of starting the project, no development work was done in the said project.

After the complaint of the plot holders, RERA decided to hand over the said project to the Chhattisgarh Housing Board, which will now take over the project and hand over the action plan for the development of necessary basic facilities to RERA within two months.

RERA chairman Vivek Dhand said that 130 plot holders of the project had complained to RERA in 2019 alleging non-completion of the development work.

During the hearing of these complaints, it came to light that the promoter of this project had obtained development permission in the year 2010 for making a fully equipped residential colony of total 1072 plots in this project and its prospectus was issued.

691 plots of the project were sold and Rs 41 crore was received from it. This project was supposed to be completed by 2015, but even after 6 years no development work has happened. The project was not even registered by the promoter under RERA as per rules.

The RERA chairman said that in compliance with an order of the Supreme Court in this regard, RERA handed over the project to the Chhattisgarh Housing Board.

The Housing Board will also register this project under RERA as per rules. Raipur District Collector has been asked to take necessary action for transfer of this project.

After the transfer of the project, Chhattisgarh Housing Board will have the right to develop the project and sell the mortgaged and unsold plots. The Chhattisgarh Housing Board will also have the right to execute the registered sale deed of the plots and receive the sale consideration.

Chhattisgarh Housing Board will complete the development work of the project as per the estimate and work plan within the stipulated time and transfer it to the residential society for the purpose of maintenance.
