Rajasthan RERA starts giving exemption certificates to builders

Developers falling under the category can now approach Raj-RERA to avail the exemption and the authority will issue an exemption certificate after charging the standard fee.

Mitesh Rathore, a lawyer familiar with the development, said, “The move will boost the development of real estate projects with builder’s funds and reduce dependence on customers for funds. Also, it will help in the completion of the project.” Will reduce the delay.

Earlier, RERA had issued show cause notices to three developers in July under Section 59 read with Section 3 of the RERA Act, 2016 for advertising their real estate projects without obtaining prior registration. However, it was argued that the promoters had not violated Section 3 or any other provision of the Act as none of the units in the disputed project were marketed or sold before its completion.

“The Authority was constituted to discharge the mandate of the Act and to regulate the duties of the promoter towards the allottees, primarily to complete the project in the promised time period, but once a project is completed After the booking and sale is done, nothing remains for the authority to regulate,” added Rathore. After the decision, the authority operates an online application module.
