Haryana RERA bans sale and purchase of properties in Vatika India Next 2

Gurugram: real estate regulator RERA has prohibited the sale and purchase of one of the projects of garden Ltd. and asked the developer to submit the required documents for its license renewal and registration of the project.

Sale and purchase of properties in Vatika India Next 2 RERA Chairman KK Khandelwal said that the project has been banned due to non-compliance of RERA Act.

In the hearing held on September 12, the regulator found that several developers, including Vatika, failed to submit documents required for registration of their projects.

Approvals for license renewal, zoning plan, service plan and estimate are still pending.

Section 3 of the Immovable Property (Regulation and Development) Act 2016 mandates RERA registration for a new project as well as any ongoing project, without which the promoter cannot start construction or any booking of plots, flats etc. can not do.

“If any promoter contravenes the provision prescribed in Section 3 of the Act, he shall be liable to fine which may extend to 10 per cent of the estimated cost of the real estate project,” Khandelwal said.

Vatika Limited received the license for the project to develop the plotted township Vatika India Next 2 from the Town and Country Planning Department, Haryana in 2013. RERA in the state was notified in July 2017. The authority has observed that several documents are still pending, including the reduction of registration fee on the part of the promoter.

The authority noted that the builder’s license has also expired and is yet to be renewed.

“The licenses of Vatakia Ltd. have expired which need to be renewed. The Authority … gives thirty days show cause notice as to why the application for grant of registration is not dismissed.

“The Authority also observed that the application has been transferred by the promoter in a very casual manner without any particulars and required information. Therefore, the Authority withholds sale and purchase in this unregistered project,” the authority said.

Apart from Vatika, the authority also sent strong messages to the promoters of Neo Square, Centra One, Zen Residence 1 and others, asking them to comply with the rules on or before the next date of hearing on October 17.

Meanwhile, the authority also cautioned people against booking plots, flats etc in these unregistered projects.

Vatika India Next 2 is being developed in about 100 acres in Sector-88A and 88B of Harsaru village of Gurugram.
