PuneAccountant Rahul Patil and his brother Hemant had booked a flat in a realty project Shirur In 2011, the taluka made his father, who was then 56 years old, its proud owner.
Though the developer had promised them delivery by October 2014, the brothers are yet to get the possession. And, meanwhile, his father passed away in 2017, after a long wait to own property he could call home.
Rahul, who is living on rent and is still repaying his home loan, is among 13 people who had booked flats in the project. All of them are running from one government office to another in the hope of getting their dues – the house they had booked, and the compensation ordered. Maharera in 2018, which could not be implemented due to the COVID-19 pandemic.
“When we realized that the project was far from completion, we approached the district consumer court, but to no avail as the compensation amount was more than Rs 1 crore. After RERA came into force, we approached the district consumer court to take up our case. Finally on June 8, 2018, MahaRERA issued an order in our favor, asking the builder to refund us the booking amount along with 10% annual interest rate,” he said.
When the administration started the auction proceedings on June 14, 2023, a nationalized bank sent a letter to the tehsildar stating that the project land is mortgaged to it, thus, stalling the process.
Another complainant, Vikas Malpote (34), who had booked a 1BHK in the project, said, “Why can’t the authorities auction the plot and recover the amount to pay the bank and us? We are all on rent.” are living and paying EMIs to repay the home loan for the promised flats.”
Rahul said, “Before the auction, the builder gave us a check of Rs 6.5 lakh each and promised to settle the amount in phases, but the checks bounced twice.”
Satish Khaire (41), a farmer from Wadgaoncherry who also invested in the project, said, “I wonder how these developers can survive and continue with projects even after defaulting on their loan payments.”
A senior bank official said, “We have stopped the auction process as the developer has defaulted on the loan payment and the property is mortgaged with us. We want the tehsildar’s office to auction the entire property and not just parts of it.” If they auction except some parts of it, it will be difficult for us to auction the remaining parts of the plot” MahaRERA chief Ajoy Mehta declined to comment on the matter.
