Gurugram: The Economic Offenses Wing (EOW) of Delhi Police has issued notices to the chairman of a realty major, its director and former managing director of its Indian operations as well as heads of three different banks and financial institutions for alleged fraud . Forgery in respect of a group housing project in Sector 83.
The notice was sent on Wednesday following complaints from home buyers that the developer – Emaar India – The layout of the project was misrepresented at the time of booking for the purpose of charging huge premium and preferred location fee (PLC) from the allottees by showing land owned by a private person and a village road as part of the project . Palm Garden, The developer also reportedly made changes to the green areas of the project after booking.
The Palm Garden was launched in 2010 by the Indian subsidiary of the Emaar Group. The possession of the flats was to be given in 2015. The project got delayed as buyers started filing complaints that banks disbursed home loans to them despite irregularities in the project.
An FIR was registered by the Delhi Police EOW on Tuesday under sections 420 (cheating), 406 (forgery) and 120B (criminal conspiracy) of the IPC. Along with Emaar, the directors of the banks and other institutions that financed the project were also made a party in the case.
The notice was issued to Emaar Group Chairman Mohd Albaber, its director Haroon Saeed Siddiqui and former India MD Hadi Badri, along with 23 others.
An Emaar India spokesperson said, “The matter pertains to a civil suit filed by the home buyers against the banks from whom they had taken loans for properties of approximately Rs 1 crore; In which the officials of Emaar have been made a party in the matter. The dispute is primarily civil in nature and is sub judice. We are following due process of law and extending our full support and cooperation for a fair investigation in the matter.
Manish Kumar Patni, a DLF 3 resident and another home buyer, said: “The developer changed the green areas of the project that were shown at the time of booking apartments. We came to know that the accused persons had not obtained requisite permissions and approvals while selling the flats. Despite several requests, the company failed to provide copies of the permissions.
