UP-RERA faces criticism for slow progress in resolving cases, ET Real Estate

Lucknow: On the Twitter timeline of the apex real estate regulatory body UP-RERAShushant Goyal posted: “I am going to end my life because of red tape.

Fraud builders have snatched my hard earned money despite UP-RERA refund order Allahabad High Courtmy refund has been denied,” (sic). I have a recovery certificate order from UP-RERA dated 2018, but till date the same has not been processed,” wrote buyer Pankaj Tiwari on Twitter.

There are dozens of such tweets on the Twitter handle of UP-RERA. Har Srivastava, a homebuyer wrote on Twitter, ‘For many years we are fighting the case to get our money back. Earlier my father used to do cases in UP-RERA, but he passed away two years ago, so now I am doing it. We do not have any source of family income and we are in dire need of money. Please solve our issue.

According to a report presented before the Allahabad High Court, since its inception in 2017, UP-Rera (first case taken up on September 4, 2018) has issued 6,866 recovery certificates (RCs) for Rs 2,125 crore, but 2,558 Only Rs 504 crore has been recovered in RC. This includes partial recovery of Rs 101 crore in 1,132 cases.

The body claimed in its report that as per the data till March 31, 2023, an additional Rs 184 crore was recovered from the mutual settlement between the homebuyers and the promoters/builders.

When TOI asked why it has failed to provide relief to such a large number of home buyers, the UP-RERA chairman Rajiv Kumar said, “Recently, Wave Megacity Center deposited a check of Rs 101.36 crore against RCs issued by UP-RERA within 11 months. Till date, the regulatory body has helped recover Rs 800 crore in 3,350 cases , either through RC or through an agreement between the home buyers and the promoters.

“After the pandemic, the district administration gathered momentum and recovered the RC amount. It sends reminders every month within the first week to the district administration for recovery. Promoters are coming forward to settle their recovery certificates to reduce their liabilities and complete projects which are projecting promising viability.
