uttarakhand high court restrains builder from making motorable road in reserved forest

Nainital: The Uttarakhand High Court on Monday restrained builder Upendra Jindal from building a motorable road far reserve of Nainital pangut Area The order came when the court was hearing a PIL filed by the village head Budhyakoti (which comes under Pangut area).

The petition states that the villagers had applied for the construction of a pedestrian path in 2013. After due scrutiny, the state forest department provided the exact coordinates with which the walkway was to be constructed and a hand drawn map signed by the village head. Approved.

However, the sanctioned coordinates were changed to suit the builder, who is also a hotelier, the petition alleged. The PIL states that the builder started construction of a motorable road instead of a pedestrian one. The petitioner also alleged that the forest area comes under the Naina Devi Bird Conservation Centre.

After hearing the matter, a division bench of Chief Justice Vipin Sanghi and Justice RC Khulbe restrained builder Upendra Jindal from using any heavy machinery, including JCB machines, in the reserved forest area. Meanwhile, the bench also asked the state forest department to file a counter-affidavit in the matter. The next hearing of the case will be on February 15, 2023.
