Thane: Additional District Consumer Disputes Redressal Commission MaharashtraAn insurance company in Thane has been ordered to pay a claim amount of Rs 30 lakh for damage caused to a complainant’s flat due to falling slab.

the commission ordered SBI General Insurance Company Ltd. has to pay the claim amount within 45 days of the order, failing which it will be liable to pay up to a recovery of 9 per cent per annum.

The order was passed on January 20 and its copy was made available on Friday.

The commission also ordered the complainant Deepak Golikar, resident Deepak Golikar, to pay Rs 50,000 towards reputational damages and cost of litigation. Koparkhairane In Navi Mumbai,

The petitioner informed the Commission that he had purchased a flat in Koparkhairane and had taken a loan of Rs 45.68 lakh from SBI in August 2019. Period from August 2019 to August 2029.

The insurer explained to the complainant that the policy would only cover all risks if the flat is damaged or destroyed in fire, earthquake or enemy attack.

On 1st December, 2020, a slab of the building in which the complainant resided fell and damaged his flat. It has been said in the petition that he had to take a rented house elsewhere.

After the accident, the complainant filed a claim, which was rejected by the insurance company on certain grounds.

The Commission observed that the surveyor’s report stated that the slab had collapsed due to the use of substandard quality construction material.

Whenever insurance is taken on a property, the bank and the insurance company carefully verify all the documents to ascertain the life of the structure.

Considering the entire evidence, there was no sufficient ground for rejecting the insurance claim, it said and ordered the insurer to pay the claim.
