NGT directs express builders to pay Rs 15 crore compensation for illegal construction

New Delhi: National Green Tribunal Directed to a builder in Noida To pay compensation of Rs 15 crore for construction of additional floors in contravention of the conditions of Environment Clearance (EC), stating that this leads to additional pollution burden on the environment.

The bench, which also included Justice Sudhir Agrawal and expert members A Senthil Val and Afroz Ahmed, observed that the construction of additional floors put an additional pollution burden on the environment and the builder was liable to pay preventive compensation on the principle of ‘polluter payment’. was.

“Given the position that the 19th floor of the five towers has been sold and occupied and the demolition would affect the rights of third parties, we think it appropriate to charge compensation with a deterrent element,” the bench said.

The bench further said: “We set it at Rs 15 crore, which is 10 per cent of the project cost as estimated in the EC, though the actual value may be higher.”

The green panel directed that the compensation be deposited with the District Magistrate, Gautam Budh Nagar within a month and after the expiry of one month, the recovery be made by permissible coercive measures.

The court said the recovered compensation can be used for restoration of the environment under the District Environment Plan.
