Ahmedabad: a bench of Gujarat The High Court on Friday banned builders and contracts Gujarat Housing Board ,GHB) for evicting a woman from her flat in GHB Colony. She is one of the members opposing the redevelopment of Anand Vihar Society at 132 Feet Ring Road.
Siddhi Developers And Builders After a single-judge bench in September 2022 paved the way for the redevelopment of 11 buildings in the society, it issued eviction notices to those unwilling to vacate the premises.
Parul Pathak, a resident of one of these buildings, challenged the eviction notice. Her lawyer accused the builders of planning to sell the four floors as commercial property when GHB had constructed houses for middle class people.
A bench of Chief Justice Arvind Kumar and Justice Ashutosh Shastri questioned the GHB about the phase of redevelopment. The court was informed that six of the 11 towers were completely vacant, and redevelopment would not be possible if there was even a single beneficiary. GHB’s counsel also told the court that the appellant woman opposed the redevelopment to save her illegal construction.
The judges asked the parties to submit photographs of the site by the next hearing on January 17. He ordered the builder and the board not to disturb Pathak pending his appeal. The GHB assured the court that Pathak’s house and the building in which his flat is located would not be demolished.
In 2018, 101 out of 132 members of the society had agreed to go ahead with the redevelopment, citing the dilapidated condition of the 40-year-old buildings. He signed the consent letter for redevelopment and requested the board to start the redevelopment process. However, protests by the remaining members resulted in litigation and a single-judge bench of the HC ordered the non-consenting members to evict the flats to make way for redevelopment.
